Insurance Coverage in a Hit-and-Run Accident

When a car accident occurs, typically the responsible driver’s insurance covers any injuries or damage that occurs as a result. Hit-and-run accidents are a bit more complicated because the responsible driver has fled the scene. Without the other driver’s information, it can be difficult to get the coverage needed for repairs and medical costs. Drivers involved in a hit-and-run accident should review their own policy to determine compensation.

Trying to Find the Responsible Driver

Ideally, it would be possible to find the responsible driver. Drivers involved in a hit-and-run accident should call 911 as soon as possible to get medical help for anyone who needs it and get the police to write a report of the accident.

If the driver can remember any details about the other vehicle, such as the color, make, and model, they should let the police know immediately. Witness statements should be gathered too, if possible. In many cases, however, the driver may not be found, leaving the burden on the victims to get coverage from their insurer.

Types of Coverage

Drivers with personal injury protection (PIP) coverage as part of their policy can submit a claim to their own insurance after a hit-and-run accident. This coverage provides compensation for any medical expenses related to the accident as well as lost wages if the insured driver must take time off work.

Pedestrians who have PIP coverage can also file a claim if they are injured by a hit-and-run driver. It does not provide compensation for damage to the driver’s vehicle or other property; however, and there may be limits to how much the driver can receive. Drivers in no-fault insurance states are required to have PIP coverage, while others may need to opt in for an additional premium.

Drivers can submit a claim under their collision insurance to get coverage for damage to their vehicle, even if they were not responsible for the accident or if the car was hit while it was parked. The policy may also include coverage for items in the car at the time of the accident. Depending on the terms of the policy, most drivers will have to pay a deductible before receiving any compensation; if the damage is less than the amount of the deductible, they will not receive a payout. Filing a claim can also result in higher premiums, even if the driver did not cause the accident.

Some policies include uninsured or underinsured motorist coverage (UIM), which can also be applied in the event of a hit-and-run. UIM claims can cover medical costs, lost wages, and pain and suffering, and in some states, it may also cover vehicle damage. UIM coverage requires an additional premium, except where required by law, and can only be purchased up to the amount of liability coverage. These claims may require negotiation with the insurance company, making it difficult to get a comprehensive settlement.
