Truck Accident: $72,500 Settlement
The case: Our client, a 50-year-old woman was a passenger in a car when a large truck turned left out of a gas station, hitting the car she was travelling in.
The challenge: The truck driver said that the driver of the car should have been able to avoid the accident. We were able to get photos taken by the State Police, which were not ordinarily available.
The solution: Our investigator – a former police officer in that area – used extra effort to get us photos showing that the truck driver only got halfway across, and the truck turned right in front of the car.
Truck accidents are different than auto accidents or any other case, and our experience enables us to navigate successfully despite the differences. Our client had serious injuries, including a broken back and a concussion. We worked hard and got a very good result.
Aggravation of Pre-existing Injuries: $500,000 Settlement
The case: Our client’s automobile was hit in the rear in two accidents close in time. He injured his neck and back and had surgery.
The challenge: Our client had a serious auto accident five years earlier and had neck surgery. He also injured his back in the prior accident. Up until a few months before these two accidents, he was still complaining about neck pain and having medical treatment.
After these two more recent rear-end collisions our client had another neck operation and another back operation. The opposing lawyers and the doctors said that it was all pre-existing. Furthermore, the MRIs before the more recent accidents looked just like the MRIs from the earlier accident.
The solution: We used a group of our client’s friends and co-workers, called lay witnesses, to prove that our client had been active and working hard prior to the recent accident. This showed that it was the new accident that severely aggravated his condition, causing the need for surgery.
