Keep Calm, Stay Focused Following a Crash

A serious car accident is a traumatizing event in the life of a motorist and passenger. No matter how much time has passed it is unlikely that a victim will ever forget the trauma that can accompany a collision. Although not all car accidents will be so serious, even during a minor fender bender it is imperative that drivers remain calm. The steps taken in the minutes, hours, and days which immediately follow a crash can determine whether compensation will later be available for injuries.

After calling 911 a driver should check on their passengers and any other motorists as long as they are physically able. Once police and paramedics have arrived, drivers should request that law enforcement file a report on the crash, and make sure to write down the names and badge numbers of all officers at the scene. If the car accident does not appear to require the presence of law enforcement, a driver should nonetheless politely but firmly insist on exchanging insurance and contact information with all other drivers involved in the car accident.

Speaking With the Other Driver

During this conversation, however, a driver must refrain from discussing the role they may have played in the crash. Even when a driver is clearly at fault – such as by running a red light or stop sign – they should avoid apologizing or otherwise discussing their actions. Even a casual or brief concession of guilt can later be used against a driver in court.

As soon as possible drivers should alert their insurer and offer an honest, accurate account of the events which led to their crash. The insurer will request a copy of any police report which was filed as well as documentation of any injuries sustained and medical treatment received. Motorists and passengers should also keep track of how their injuries have adversely affected their daily lives. Severe pain will not only keep an injured party from working, but also from participating in family outings and other life events they would have otherwise enjoyed. If a lawsuit is to arise from a car accident, such losses could be compensable.
